Terms of Use
Please read the following Terms and Conditions carefully, as they form the agreement between us. If you do not agree to these terms and conditions, you may not use the service and should not proceed to register.
User Agreement
This Agreement constitutes your agreement with Exploriada.com ("Exploriada") with respect to your use of the Service. You must agree to abide by all of the terms and conditions contained in this Agreement in order to become or remain an authorised user of the Service. As used in this Agreement, "we" and "us" means Exploriada or any successor or assign of Exploriada.
Right to Use
Your right to use the Service is subject to any limitations, conditions and restrictions established by us from time to time, in our sole discretion. We may alter, suspend or discontinue any aspect of the Service at any time, including the availability of any Service feature, database or content. We may also impose limits on certain features and aspects of the Service or restrict your access to parts or all of the Service without notice or liability.
Code of Conduct
1. By becoming a Exploriada member, you verify that you are at least 18 years old. Membership is not open to minors.
2. Your Exploriada membership is for your personal use. You may not authorise others to use your membership and you may not assign or transfer your account to any other person or entity.
3. You are responsible for the content you submit on our site and to other Exploriada members.
4. You will use Exploriada in a manner that is consistent with any and all applicable laws and regulations.
5. You will not include in your profile any phone numbers, addresses, last names, URLs or e-mail addresses other than where it is requested in your Profile and other forms. Especially, you will not drop promotional urls, signature files, nor specifics that would lead people to oher sites.
6. You will not post on Exploriada site or transmit to other members any defamatory, abusive, obscene, profane, offensive, sexually-oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes on or violates another's rights.
7. You will not include in your profile any offensive anatomical or sexual references or sexually suggestive language and you will not post any photos containing nudity or personal information. Exploriada reserves the right, but has no obligation, to reject any profile or photo that does comply with these requirements.
8. We may also refuse to grant you an ID that impersonates someone else, is protected by trade-mark or proprietary law, or is vulgar or otherwise offensive, as determined by us in our sole discretion.
9. You will not engage in advertising to or solicitation of other members to buy or sell any products or services through Exploriada. You will not transmit chain letters or junk e-mail to other members. To protect its members from this conduct, Exploriada has imposed a 6 message per day limit.
10. You will not use the Service to distribute or upload any virus, trojan horses or do anything else that might cause harm to the Service, Exploriada systems or to other members' systems in any way.
11. You will not post, distribute or reproduce any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner.
12. You are solely responsible for your interactions with other members. Exploriada reserves the right, but has no obligation, to monitor and/or mediate disputes between members.
13. Either you or Exploriada may terminate your membership at any time, for any reason, without explanation, effective upon sending written notice to the other party. Exploriada reserves the right to immediately suspend or terminate your access to the Exploriada service, without notice, upon any breach of this Agreement by you that is brought to Exploriada's attention.
14. You will defend, indemnify, and hold harmless Exploriada, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the Exploriada service, including any breach by you of the terms of this agreement.
15. Opinions, advice, statements, offers, or other information or content made available through the Exploriada service, but not directly by Exploriada, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. Exploriada does not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than Exploriada. Under no circumstances will Exploriada be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on the Exploriada service or transmitted to Exploriada members.
16. It is possible that other Exploriada members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on the Exploriada service and that you may be involuntarily exposed to such offensive and obscene materials. It also is remotely possible for others to obtain personal information about you due to your use of the service, and that the recipient may use such information to harass or injure you. Exploriada is not responsible for the use of any personal information that you disclose on the Service. Please carefully select the type of information that you post on the Exploriada service or release to others.
17. Exploriada will keep confidential all information supplied by you to, including your name, address, phone number, e-mail address, credit card number(s), and shall use or disclose such information only for the purposes for which such information was collected, or as required by law or for demographics. Please see Privacy Statement for more detailed information concerning confidentiality.
18. Exploriada does not screen members in any way and, therefore, is not liable for any damages, direct, indirect, incidental and/or consequential, arising out of the use of this service, including, without limitation, damages arising out of communicating and/or meeting with other members of this service or introduced to you via this service. Such damages include, without limitation, physical damages, bodily injury and/or emotional distress and discomfort.
No Responsibility
You acknowledge that we are not responsible for suspension of the Service, regardless of the cause of the interruption or suspension. Any claim against us shall be limited to the amount you paid, if any, for use of the Service during the previous 12 months. We may discontinue or change the Service or its availability to you at any time, and you may stop using the Service at any time.
No Warranties
The Service is distributed on an "as is" basis. We do not warrant that this Service will be uninterrupted or error-free. There may be delays, omissions, and interruptions in the availability of the Service. Where permitted by law, you acknowledge that the Service is provided without any warranties of any kind whatsoever, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
